이번 논문의 목표는 레비나스의 인권 사유를 추적하는 것이다. 그의 철학에서 인권을 중점적으로 사유하는 일이 그의 철학의 본질적 강조점에 반하는 것은 아닌가, 혹은 적어도 그의 중심적 문제의식을 희석시키는 것은 아닌가 하는 의구심이 들 수도 있을 것이다. 인권의 문제하면 응당 떠오르는 보편성의 문제와, 나보다는 타인을, 자유보다는 책임을 강조하는 타자의 철학자가 공존할 수 있는가 하는 문제도 여전히 남아있다. 하지만 필자는 레비나스의 인권 사유가 그의 철학적 문제의식을 보여주는 구체적 사례일 수 있으며, 나아가 인권 담론의 새로운 지평을 열어 줄 수 있다고 생각한다. 레비나스에서 정의는 권한을 가진 ‘나’가 아니라 세계 속의 자리를 박탈당한 ‘타자’에게서 출발한다. 타자에 대한 책임으로서의 정의가 인권의 직접적 기초를 이루는 건 이 때문이다. 레비나스는 “인권은 근원적으로 다른 인간의 권리”라고 주장한다. 이때 중요한 것은 타인의 권리로서의 인권은 더 이상 국가나 원리 혹은 시민권의 상호계약에 의존하지 않는다는 점이다. 레비나스는 인권이 ‘치외법권’의 영역임을 강조한다. 인권은 국가를 넘어선다는 점에서, 주체를 넘어선다는 점에서 치외법권의 영역이다. 인권은 주체의 자유의지에서가 아니라 타자의 얼굴에서 비롯한다. 그런 한에서 진정한 의미의 인권 보호는 ‘타인의 인간주의’ 속에서만 가능하다. 타인의 인간주의는 자아의 중심성을 문제 삼고 타자의 우위를 인정하는 가운데서만 이룩될 수 있다. 기존의 인간주의가 보편적 인간을 가치의 원천으로 삼았던 반면, 타인의 인간주의는 타자를, 타자를 위한 책임을 가치의 원천으로 삼는다.

This paper sketches the view of Emmanuel Lévinas on human rights. One may wonder whether the emphasis on human rights would go against the essential point of his philosophy. In my opinion, the Levinasian conception of human rights can provide a new path into discourse of human rights. Justice departs not from the empowered ego but from the homeless Other. The responsibility for the Other as justice forms the direct basis for human rights. Through it, Lévinas proposes “Human rights are originally the rights of the Other person.” His conception of justice goes with that of human rights. It is important to understand that human rights as the rights of the Other do not depend on the principle of state or the reciprocal contract of civil rights. He explains that human rights is the sphere of ‘extra-territoriality’. Human rights are extra-territorial in the sense of transcending the state and the subject. The very excellence of human rights is possible only in the ‘humanism of the Other’. It is based on the responsibility according to the appeal and call of the Other, which implies the decentralisation of ego. While the humanism of the ego claims the concept ‘man’ to be the source of value, the humanism of the Other claims the Other as this.
