남북한의 관계는 현재의 최악의 국면에서 벗어나면 북한의 개혁·개방, 남북한의 평화공존과 교류협력, 남북한의 통일·통합의 방향으로 발전하여갈 것인데, 위와 같은 상황의 전개를 촉진하거나 이에 대비할 남북한의 다방면의 노력이 필요하다. 민사소송은 사법상 분쟁의 해결을 위한 절차적 제도로서, 위와 같은 상황의 전개에 따라 급증할 사법상 분쟁을 적정하고 효율적으로 해결할 수있도록 미리 남북한의 민사소송에 대한 이해·평가 및 정비를 진행하여야 한다. 북한 민사소송은 그 체제 내에서 일정한 기능을 수행하고 있지만, 위와 같은 상황의 전개를 촉진하거나 이에 부응하기에는 어려움이 있다. 이는 수령유일영도체제가 지배하는 사회주의국가인 북한의 체제와 이념이 북한 민사소송에 결정적 영향을 미치기 때문이다. 다만 이러한 요소를 제외 하면 북한 민사소송은 나름대로의 합리성과 통용력을 가지고 있다고 보인다. 북한 민사소송의 특징을 몇 가지 들어보면 다음과 같다. ①기관, 기업소, 단체, 공민의 민사상 권리와 이익의 보호라는 민사소송법의 사명이 명문으로 규정되어 있다. ②북한 민사소송의 기본 원칙으로서 재판소의 책임성에 소송당사자의 적극성을 배합하는 원칙, 민사소송활동을 인민대 중에 의거하여 진행하는 원칙 등이 강조되고 있다. ③민사소송상 신의칙은 일반원칙이 아니고 소송당사자의 의무로서 규정되어 있다. ④민사소송사항에는 가사소송사건이 포함되어 있고, 사실도 확인의 소의 대상이 되어 있다, ⑤판사와 함께 인민참심원이 재판소를 구성하고, 검사가 광범위하게 관여한다. ⑥직권주의가 지배적이고, 당사자처분권주의와 변론 주의는 배제·제한되어 있다. ⑦판사에 의한 재판준비가 철저하게 이루어 진다. 남북한의 통일·통합을 향한 일련의 과정에서, 북한 민사소송 중 북한의 체제와 이념을 직접 구현하는 제도와 절차는 가능하면 배제하거나 축소하여야 한다. 물론 북한의 정치체제와 경제체제의 전환이 이루어지고, 이를 반영하는 방향으로 실체사법의 제정이나 개정이 이루어지면 북한의 민사소송도 이에 따라 자연스럽게 변화·발전될 것이다. 이러한 변화·발전에 대비하거나 이러한 변화·발전을 추동하기 위해서도 북한 민사소송의 연구는 매우 중요하다. 북한이 그 체제와 이념을 어느 정도 유지하는 선에서 개혁·개방이나 한국과의 교류협력을 행하는 경우이더라도 북한 민사소송제도는 상당한 정도로 개선·정비되어야 하는데, 북한 민사소송의 연구는 그 개선·정비에 대한 지원을 위해서도 절실히 필요한 작업이다. 한편, 한국의 민사소송제도가 완벽한 것은 아니므로 북한 민사소송의 연구를 통하여 민사소송의 본질을 탐색하고 비교법적으로 한국의 민사소송제도나 구체적 절차의 문제점을 파악하고 그 개선책을 모색하는 것도 매우 유익한 일이 될 것이다.

고려말기 상감청자의 전통을 계승하여 제작되기 시작한 분청사기는 전국 각지의 가마들을 통해 다양한 모습으로 제작되는데, 특히 경상도 지역에서는 인화 분청사기, 충청도에서는 철화 분청사기, 전라도에서는 조화박지 분청사기가 유행하는 지역적인 특색을 보인다. 본 논문은 이러한 분청사기의 특징으로 얘기되는 지역적 특색에 대해 현재까지 발굴조사를 통해 알려진 전라도 지역 가마터의 현황을 살펴보고 그 성격에 보다 구체적으로 접근해 보고자 하였다. 조사된 자료를 통해 운영시기, 지역에 따른 제작 양상 등 지역적인 특징을 파악할 수 있을 것으로 생각된다. 분청사기 가마터는 1980년대를 시작으로 지표조사와 발굴이 활발하게 진행되고 있는데, 본 글에서는 전남지역 광주 충효동, 고흥 운대리, 보성 도촌리, 영암 상월리, 곡성 구성리, 장성 추암리 등과 전북지역 부안 우동리, 완주 화심리, 고창 수동리, 고창 용계리, 고창 용산리, 김제 청도리 등 발굴조사가 이루어진 가마터를 대상으로 발굴 개요 및 출토 유물의 특징을 살펴보고, 기형, 시문 장식기법, 명문을 중심으로 그 성격과 제작시기 등을 살펴보았다. 전라지역 분청사기의 특징은 첫째 제기의 제작, 둘째 시문장식기법 중 조화박지 기법과 분장기법에서 그 특징을 크게 꼽을 수 있는데, 반상기와 저장운반용기의 구분에 따른 시문기법의 차이가 나는 것을 알 수 있다. 셋째, 조선청자, 백자, 흑유와 동반 생산되고 있다. 넷째, 출토되는 명문 중 관사명으로는 ‘내섬’, ‘예빈’, ‘인수’, ‘장흥’, ‘사(선)’ 이 있다. 이 외에도 지명, 용도, 사기장 이름, 품질표시, 지방관아명 등의 명문도 일부 보인다. 이러한 특징들을 종합해 볼 때, 고려말 상감청자의 전통을 이은 상감 분청사기의 제작에서부터 백자로 이행해가는 과정, 분청사기의 마지막 단계인 덤벙분장 분청사기의 제작까지도 모두 포함하고 있어 전라지역 분청사기의 제작시기는 14세기 말~16세기 전반까지라고 말할 수 있다. 향후 다른 지역 분청사기와 비교한다면 전라지역 분청사기의 특징과 성격이 보다 명확해지리라 생각된다. Taking the baton from the sanggam (inlaid) celadon tradition at the end of the Goryeo Dynasty, buncheong ware began to be produced in a variety of forms at kilns across the country. Gyeongsang-do Province mainly produced buncheong ware with stamped designs. In Chungcheong-do Province, buncheong with designs in iron underglaze prevailed Jeolla-do Province specialized in buncheong with incised and sgraffito designs. This paper examines the regional characteristics of buncheong ware by scrutinizing buncheong kiln sites in Jeolla-do that have been discovered in excavation surveys. This survey data will also aid in the identification of regional characteristics, such as operation periods of kilns and aspects of buncheong production. Buncheong kiln sites have been investigated through excavations and ground surveys conducted since the 1980s. This paper analyzes excavations and excavated relics from surveyed kiln sites in Chunghyo-dong, Gwangju; Undae-ri, Goheung; Dochon-ri, Boseong; Sangwol-ri, Yeongam; Guseong-ri, Gokseong; and Chuam-ri, Jangseong in South Jeolla-do Province as well as Udong-ri, Buan; Hwasim-ri, Wanju; Sudong-ri, Gochang; Yonggye-ri, Gochang; Yongsan-ri, Gochang; and Cheongdo-ri, Gimje in North Jeolla-do Province. It further explores characteristics and production dates of buncheong wares by inspecting forms, decoration methods, and inscriptions. The four distinctive features of the buncheong ware produced in Jeolla-do Province are as follows: (1) the prevalence of ritual vessels; (2) the wide use of incising, sgraffito, and slipping methods, which were employed differently in tableware and containers for storage and transportation; (3) the production of Joseon celadon, white porcelain, and black-glazed stoneware alongside buncheong ware; (4) inscriptions of office names, such as “Naeseom” (Procurement Office), “Yebin” (Dignitary Reception Agency), “Insu” (Office of Abdicated Kings), “Jangheung” Office, and “Sa (seon)” (Office of Royal Cuisine), as well as place names, intended uses, names of master ceramicists, quality marks, and names of regional offices. Buncheong wares from Jeolla-do include the sanggam buncheong that inherited the tradition of sanggam celadon in the late Goryeo period and evolved into white porcelain and the buncheong dipped in white slip, the type that emerged in the final stage of buncheong’s development. Buncheong wares from Jeolla-do appear to have been produced in the late fourteenth to early sixteenth centuries. Further comparison between buncheong wares from Jeolla-do and those from other regions will help to more clearly characterize Jeolla-do buncheong wares.

부산광역시 동북쪽에 위치한 기장군에서 도예촌 조성과 관련하여 2007년 2월부터 7월까지 지표조사가 이루어졌다. 이 조사에서 장안읍 일대를 중심으로 모두 7개 지점에서 도요지 관련유적을 확인하는 성과를 거두었다. 그중 기장군 장안읍에 위치한 장안리 상장안 자기요지는 ‘蔚山長興庫’, ‘耕負祭’ 등의 명문이 있는 분청사기와 炙??희준?보?고족배와 같은 제기가 발견되어, ??경상도속찬지리지?? 울산군에 기록된 도기소?자기소에서 하품을 생산하던 장안리현으로 추정된다. 요지는 후대의 인위적인 훼손으로 가마 유구의 현상 파악은 어려우나 지표조사에서 수습된 다량의 도자편 분석을 통해 이들 유적에 대한 편년연구가 가능하며, 부산?경남지역 도자사 연구에 기여하는 바가 높다고 판단하였다. 본 논문에서는 장안리 상장안 자기 요지의 제작시기를 살펴보기 위해 먼저, 요지 도자편의 기종과 기형, 문양, 제작수법을 검토해 보았다. 가장 많이 수습된 기종은 대접과 접시이며, 그 외 기타 도자편과 요도구 등도 확인하였다. 문양은 확인된 도자편의 크기가 대체로 작아 전체적인 문양구성을 살피는 데 한계가 있으나 일반적인 문양 구성과 위치에 근거하여 주문양과 종속문양으로 나누어 분류하였다. 제작수법에서는 유태와 굽의 깎음새, 번조수법의 양상은 갑번인지 포개구이 번조인지에 대한 여부와 받침은 어떠한 것이 사용되었는지 살펴보았다. 장안리 상장안 자기요지는 광주광역시 충효동 요지의 안정된 6개 층위에서 확인된 유물의 양상, 그리고 제기형태의 변화를 통해 제작시기를 판단하였고, 또한 ??경상도속찬지리지??의 울산군조의 도기소와 자기소 기록에서 중요한 단서를 제공 받았다. 장안리 상장안 자기요지는 1450~1470년대 사이가 요업의 중심시기인 것으로 판단하였다. A research of earth surface was conducted by me from February to July 2007 on the subject of ancient formation of ceramic art villages at Gijang county, Busan. The research, though it was just a survey of earth surface, is a significant work since no research has been conducted till now concerning pottery at Gijang area and reported officially to the learned circles. From the pottery located at Janganri village was discovered ‘Buncheong ware’ that retains inscriptions such as ‘Ulsan Jangheung Go(warehouse)’ and ‘Gyeongbu Je (festival).’ In addition, utensils used in religious services such as ‘Jajeop,’ ‘Hijun,’ ‘Bo’ and ‘Gojokbae’ were confirmed through the Janganri pottery. The place seems identical to ‘Janganri-hyeon’ of Ulsan recorded in ??Gyeongsang-doSokchanJiriji??(geographical book published in Gyeongsang province) where low grade chinaware were produced. The mentioned pottery was marred by posterity, so observation of its remained structure has become difficult. However, I decided that with the recovered slices, chronological research of the three remains is worth trying, so I brought it up as the object of my study. To determine the production period of the potteries, I first reviewed the kinds and techniques of production, together with patterns and abnormalities of the slices. Bowls and dishes were focal points of my survey as they are kinds that have been recovered most so far. Other items such as ceramic slices and kiln tools were also investigated. However, I have encountered limitation in studying the whole composition of pattern since most of the excavated slices were small sized. Nonetheless, I have classified them into main pattern and subordinate pattern based on general composition of patterns and their locations as well as their appearing ratio. As for production skill, I observed cutting shape of ‘Yutae’ (special oil painting) and bottom of the slices, their firing technique, whether they are ‘Gapbeon’ (high-grade product) or ‘Pogae Gui’ fired one, and what material was used as prop. As a result of my observing the ceramic slices from Gijang area, I came to know that the most prominent features of the three potteries lie in ‘Yeondang Chomun’ celadon porcelains from Sinri and Daeryong potteries, the ‘Buncheong’ chinaware (with inscription of authorities) from Janganri pottery, and the utensil production for religious service. Through the above analysis, along with study of documentary records and comparison with other remains that were recovered from stable stratum or bearing dates, I could surmise the specific production period of each pottery. As for the pottery at Janganri, I have surmised its production period through shapes of the remains recovered from 6 stable strata of pottery at Chunghyo-dong, Gwangju city, together with changed forms of religious utensils. I was also given important hint from the records on chinaware potteries at Ulsan county described in ??Gyeongsang- doSokchanJiriji??. As the result of my research I conclude that the pottery at Janganri started ceramic production somewhere between 1450?1470.

Efforts to restore the original form of Hanyangdoseong after liberation were made in the 1961s, starting with partial repair of the eastern side wall of Changuimun Gate, along with maintenance and restoration of about 29 excavation surveys. Among them, among the nine excavations that have been discovered, we will focus on celadon, buncheong ware, porcelain, which can be made in a specific time or easier for the other year, and through these relics, we will try to understand the characteristics of Hanyangdoseong, which has lasted from the time of the construction of King Taejo in the Joseon Dynasty to the late Joseon Dynasty. Among the excavated relics, we looked at the artifacts excavated from Hanyangdoseong excavation survey, focusing on celadon, buncheong ware, porcelain that are relatively clear about the timing of their production. Although it is only a small amount, we started with celadon during the Goryeo Dynasty and looked at artifacts that could specify the production period, such as the official name Buncheong celadon, the prestigious white porcelain, and the blue and white porcelain of the late Joseon Dynasty, and found that the production period lasted from the early Joseon Dynasty to the late Joseon Dynasty. It was found that the supply of white porcelain continued through the process of grasping the formative characteristics of a large number of coarse white porcelain made of concave hooves after the 17th century, and through this, It could find that not only high-quality white porcelain but also grilled coarse white porcelain was introduced into the ruins of Hanyangdoseong. In addition, even if it is only a fragmentary appearance, the relics excavated from large-scale building sites such as "Cheongjin-dong Ruins" and "Gongyeong-dong Ruins" in downtown Seoul were similarly confirmed in the excavation of Hanyangdoseong which provided a glimpse of Hanyangdoseong which contains the essence of politics, economy, society, and culture of Hanyang during the Joseon Dynasty. It is hoped that the excavation of downtown Seoul, which has been actively conducted since the 2000s, will be restored and used as a material for cultural contents.

This study investigates the background behind the production and collection of taxation ceramics during the late Goryeo dynasty, as revealed through inscribed celadon. It also examines the chronological changes in the content of the inscriptions and the evolving characteristics of their production. During the late Goryeo dynasty, political and social instability both at home and abroad made it difficult to maintain a stable tribute collection system, leading to serious abuses in the taxation process. In response, King Chungseon ordered the Saheonbu to prevent the royal court’s close associates from exploiting the system and misappropriating tribute goods for personal use. As a result of these reforms, inscribed celadon bearing information such as the year of production and the place of delivery began to be produced as official taxation ceramics. Prior to the late Goryeo period, inscriptions on celadon primarily consisted of the names of makers or owners and were usually placed in inconspicuous locations where they were not easily visible during use. However, celadon from the late Goryeo period is characterized by inscriptions prominently placed on the exterior of the vessels, clearly displaying information such as the production date and place of use. Celadon vessels bearing cyclical year inscriptions (ganji-myeong celadon) were produced at Daeguso in Gangjin, Jeollanam-do, by state order for use by the royal court and Buddhist temples. These ceramics were standardized in terms of form, shape, and size, and the decorative patterns followed consistent conventions depending on the vessel type. Such uniformity suggests that the primary purpose of ganji-myeong celadon was to ensure a stable and regulated supply of official ware. By contrast, celadon vessels inscribed with government office names (gwansa-myeong celadon) are mostly identified as standardized storage containers. Unlike ganji-myeong wares, however, they lack formalized vessel shapes or decorative conventions. This indicates that gwansa-myeong celadon was likely produced not for the functional use of the containers themselves, but rather to facilitate the storage and transport of their contents, reflecting a different purpose and use from earlier ganji-myeong ceramics.
