        대학교원 재임용 심사 관련 소청 쟁점 검토

        이 연구는 대학교원 재임용심사와 관련하여 비정년트랙 교원의 청구인적격, 소청 청구기간, 심사 기준 및 재임용 거부 처분 취소의 효과 등 쟁점 사항을 중심으로 검토하였으며 그 결과는 다음과 같다. 첫째, 비록 비정년트랙 교원이라도 전임교원과 같은 절차로써 임용되고 교수로서의 의무를 다하고 있으며 교육부에 전임교원으로 보고되었다면 청구인적격을 인정해야 한다. 둘째, 재임용거부처분에 대한 무효확인을 구하는 청구에서도 30일의 소청심사 청구기간의 제한을 받아야 하며 특히 국공립교원의 경우에는 행정심판법상 誤告知, 不告知 규정을 적용할 필요성이 있다. 셋째, 재임용 심사는 ‘객관적ㆍ합리적인 사유에 의한 정당한 평가’가 되어야 하며 특히 정성적 평가에 있어 기준의 객관성 및 평가의 정당성을 충족시킬 수 있는 조건들에 대하여 검토하였다. 네 번째로 절차상의 하자로 인하여 재임용거부처분이 취소된 경우 대학은 절차하자 이후 부분부터 재임용 절차를 다시 진행하는 것이 타당하며 교원소청심사위원회 결정의 실효성을 확보하기 위하여 교육부의 행재정조치와 교원지위향상을 위한 특별법에 이행 강제 조항의 신설 등을 제안하였다. This study was performed to inspect a few things concerning reappointment judgement of university faculty, focusing on the points of disputing issues such as the applicant eligibility, request period, judgement criterion of irregular track faculty and effects of withdrawing disposal of reappointment disapproval. The results are as follows. First, if irregular track faculty were appointed with the same procedure as regular faculty and did their duty as professors, their eligibility of application should be recognized. Second, in the request which seeks invalidity confirmation against of reappointment disapproval, a thirty day period of consideration for the request judgement should be granted. The case for national and public school faculty should be applied by regulations such as wrong-notification and non-notification according to the administrative judgement law. Third, reappointment judgement should be :??a justifiable assessment by rational standard??and especially, the case of rational estimation was inspected under the conditions by which objectivity of standard and justice of estimation could be fulfilled. Fourth, to obtain the practical efficiency of committee's decision, administrative regulations of Ministry of Education along with new construction of "compulsive enforcement provisions" to the special law for the advancement of faculty position were suggested.

        국립대학 재정 회계제도 개선 관련 쟁점 분석

        Focusing on 'National university accounting bill' currently pending at the National Assembly, with respect to the improvement of accounting system of national universities, this study examines the major issues to be considered for the National Assembly to pass the bill. The results of the study are as follows: First, in order to get the bill passed in the National Assembly, the government financial support should be given at least at the same level as that of 'Seoul National University Incorporation Bill'. Second, it was suggested that usage fee for state-owned properties should be included into the tuition fee account, and it is necessary to prepare legal basis with respect to the succession of the employees at the existing school support organizations. Third, institutional framework should be made to suppress increase of tuition fee, and provisions are needed to explicitly state the participation of students in the Financial Committee. Finally, the suggestion was made that it is reasonable to push ahead with 'National university accounting bill', under the premise of expanding government financial support to national universities and of guaranteeing autonomy of financial operation of universities.

        비정규직보호법 시행에 따른 대학 비정규직 교원 관련 쟁점 연구

        This study reviewed the following relevant issues of the Act on the Protection of Fixed-term and Part-time Employees (hereinafter Fixed-term Employment Act): the scope of faculty members that the Fixed-term Employment Act is applied to, the recognition of working time and continuous work, the existence of comparable full-time workers, and the status of part-time lecturers when shifted into workers with no fixed-term labor contract. The followings are the results of this study. First, non-tenure track faculty members are excluded from the application of the Fixed-term Employment Act. Second, in order for the teaching preparation time of part-time lecturers to be recognized, it is necessary for the government authority to show a strong will to provide systematic and political support. Third, it is proper that any expedient use of part-time lecturers or the temporary suspension of employment during the vacation is considered as a continuous employment. Fourth, part-time lectures have the right to request the correction of any discriminative conditions in comparison with their full-time counterparts, only to see little actual benefit. Finally, even though part-time lecturers are shifted to workers with no fixed-term labor contract, there will be limitations on improving the working conditions. Therefore, fundamental measures for the part-time employees are needed to improve their legal status and working conditions through a realistic supplementation of education relevant laws.

        대학교수 발명의 특허 소유권 및 인센티브 제도에 관한 비판적 검토

        이 연구는 대학교수의 발명에 대해 직무발명 해당여부, 특허권리 귀속관계 및 금전적인센티브의 쟁점사항을 중심으로 검토하였으며 그 결과는 다음과 같다. 첫째, 종래 대학교수의 통상·일상적인 연구 성과로 발생된 특허는 교수개인의 자유발명으로 보아 교수개인이 소유하여야 한다는 견해가 통설적이었으나, 이 연구의 견해로 이들 특허권은 대학교수의 자유발명으로 취급되어 교수개인이 소유하는 것이 아니라 대학의 직무발명으로 취급되어 대학의 산학협력단이 소유해야 한다는 것을 입증하였다. 둘째, 연구개발비를 국가, 기업 등이 단독·공동으로 지원하여 연구개발한 대학교수의 발명은 대학의 직무발명에 해당되므로 대학의 산학협력단이 그 특허권을 단독 또는 공동 소유하는 것이 바람직한 방향으로 검토되었다. 셋째, 대학교수, 연구기관 연구원, 공무원 등의 직무발명에 대한 인센티브 지급금액을 비교·검토해 본 결과 대학교수, 공무원, 연구기관 연구원순으로 더 많았으며, 일부 대학에서 교수의 인센티브 지급비율은 선진국에 비해 제도상으로 거의 2배 수준에 이르는 것으로 파악되었다. 이에 인센티브의 지급비율을 선진국 수준으로 조정·검토하는 것이 바람직하다고 하겠다. This study reviews the system of employees’ inventions by university professors focusing on the boundary of employees’ inventions (i.e., whether an invention can be regarded as an employee’s invention), the reversion of the rights, and the financial incentives. The results are as follows: First, traditionally, university professors’ inventions has been considered as free inventions, while this study suggests that university professors’ research results should be taken as employees’ inventions. Second, the industry-university cooperation foundation should have the intellectual property rights of the inventions since university professors’ inventions fall under the employees’ inventions when the funding of their research comes from the government or enterprises individually or cooperatively. Third, the comparisons show that professors, civil servants and researchers at research institutes are ranked in order of the amount of incentive paid to them and that the ratio of the incentive paid to professors is almost up to double than that of advanced countries. It suggests that the ratio should be readjusted to the level of those other countries.

        서울대학교와 캘리포니아 대학의 거버넌스 비교연구

        In this study, led by University of California and Seoul National University, the relationship with the university and nation, university’s internal governance issues related to the subject of autonomy, democracy, and accountability, such as the value of comparative analysis compliance, are as follows: First, the Constitution of the University of California is more stable than that of Seoul National University, and the financial support of the government specified in the law in the case of Seoul National University gaining more autonomy would be advantageous. Second, if the governor and legislature of University of California Regent overly criticize demand operational efficiency, it will infringe on the autonomy of university. Third, the director of the Seoul National University has more democratic value of/ than UC and needs to have a long term of service. University of California reflected in a higher value of the accountability than the appointed director of the Seoul National University. Fourth, with multiple campuses with a single board of directors easily get country``s autonomy than each campus board system. Campus board of directors gets higher autonomy and democracy. However, regarding efficiency and accountability, a single board of directors system is more efficient. Fifth, regarding the president appointment, the University of California gets higher accountability and Seoul National University gets higher democracy. Sixth, with historical tradition, the University of California governance settles shared governance through the delegation of authority.
